1. TERMS & CONDITIONS
1.1 These Terms and Conditions apply to the on-line orders placed by the customers of Loui&me. By accepting the Terms and Conditions, the customer enters into an agreement with Loui&me having its registered office at ul. Słowików 28/2, 41940 Piekary Śląskie, Poland (hereafter Loui&me).
1.2 It’s the customer obligation to accept and take notice of the Terms and Conditions before placing any order. Loui&me reserves the right to modify the Terms and Conditions from time to time. Any changes made after placing the order will not affect that order unless required by law.
2. APPLICABLE LAW
2.1 These Terms and Conditions and all disputes arising in connection therewith or with the use of a website or with any purchase made on the website shall be governed by the applicable Polish law. As Loui&me may modify or amend these Terms and Conditions at any moment, the customer is asked to accept only the Terms and Conditions applicable at the time of purchase.
2.2 In matters not regulated thereby, the provisions of the Polish Law, particularly the Civil Code and the Act on the specific conditions of consumer sale and amendment of the Civil Code (Journal of Law No. 141 of 2002 item 1176) and Law on protection of consumer rights (Journal of Law No. 22 of 2000 item 271) shall apply.
3. OWNERSHIP OF RIGHTS
3.1 All rights, including copyrights at loui.me website remain with Loui&me. Any use of this website or its contents, including copying or storing in whole or part, other than for the personal, non-commercial use is prohibited without written permission.
3.2 All names of products offered for sale through the Loui&me website are used for identification purposes and may be protected and registered under the provisions of the Industrial Property Law (Journal of Law No 119 of 2003 item 1117).
3.3 Patterns, designs and sizes/dimensions as well as the names of the products offered at the Loui&me website are reserved by Loui&me. Copyrights to these are also reserved as mentioned in the point 3.1 above.
4.1 Before proceeding to payment, the customer can review its order, including the total price inclusive of VAT and shipping charges, and make changes if needed. The customer is bound by the order from the moment of confirmation thereof and the Terms and Conditions thereby stipulated have been fulfilled. This occurs once the order has been submitted and payment is confirmed. Please note that the order will not be valid if Loui&me cannot confirm the billing and shipping address(es) provided. Once the order is confirmed, the customer will receive an online confirmation at the end of the checkout, as well as a digital order confirmation via email. This confirmation is a receipt of the order placed online. A digital delivery note is sent via email when the order is shipped. This is a confirmation of a delivery.
4.2 Only the items that are in stock can be purchased. Products may sell out during the shopping session, and stock availability will be updated accordingly. Loui&me cannot guarantee items availability online or in our stores via the website as some products that can be seen online are only available, or may be sold out, in selected stores.
4.3 We reserve the right to alter/change/cancel an order in the event that stock levels have been incorrectly displayed by the time of the order placement.
4.4 The presence of the product at www.loui.me does not mean the availability of goods and the possibility of the realization of the order. These goods are marked as sold / unavailable. However, the customer can send inquiries about availability of such goods.
4.5 Products presented at www.loui.me do not constitute an offer within the meaning of the Civil Code.
4.6 All product information displayed on www.loui.me are subject to change.
4.7 The differences between the visualization of the products available at the website of Loui&me resulting from the customer’s individual computer settings (color, aspect ratio, etc.) cannot be the basis of the complaint and the return of goods purchased through the website.
5.1 Loui&me accepts payments through VISA, Mastercard, PayPal and bank transfer.
5.2 When paying by bank transfer please remember to quote the order number which will speed up the processing of the order.
5.3 Prices given at Loui.me are provided in EUR. All prices are subject to change. Loui&me cannot be held responsible for any currency changes or currency exchange rates any bank may have when exchanging the currencies.
6. DELIVERY & FREIGHT
6.1 The shipping country is chosen at checkout. All prices, currencies, VAT, delivery times and delivery charges will be adjusted depending on the country of shipment. Loui&me will dispatch the approved orders within 1-5 days (Monday-Friday) or as quickly as possible and in the order that they have been received. Exceptions to this may occur during releases, inventory management, bank holidays and sale periods when handling may take more time.
6.2 Estimated delivery times are to be used as a guide only and commence from the date of dispatch. Delivery times are dependent on the country where goods are shipped to and the choice of freight method. Loui&me is not responsible for any delays caused by destination customs clearance processes. If a delivery suffers a delay or if the delivery cannot be dispatched or only partially dispatched due to the goods not being in stock or other reasons, the customer will be informed about this as quickly as possible or at the latest 30 days after the order was placed. In this case, the customer will be given the option to terminate the agreement, free of charge. Loui&me will refund the consumer in full, at the latest within 30 days after termination.
6.3 Shipping fees are specified in € (Euro) and will be displayed in checkout before the final payment step. Actual freight cost are dependent on the country where goods are shipped to, the choice of freight method and the weight of the order.
6.4 Loui&me will not pay shipping for uncollected packages. Customers will be charged with the cost of return freight and administrative fees.
6.5 Prices include VAT when ordering to countries inside the EU. Orders to countries outside the EU may be subject to VAT, import duties and/or taxes, which are levied once the package reaches a country of destination. Please contact local customs office for more information.
6.5 If you as a customer upon receiving your goods acknowledge that the shipment is visibly damaged from transportation you have the responsibility to report this to the local forwarding agent, this goes for both pick-up and home deliveries. If you as a customer upon unboxing your order acknowledge that the goods are damaged or that items are missing, you are responsible to contact Loui&me’s customer service within 7 from delivery with your order number and shipment number from your local forwarding agent. The economic responsibility is yours if products are damaged or missing during the return transport.
6.6 If a situation occurs where the customer receives wrong and/or duplicate order(s) Loui&me reserves its right to get back all products in its original condition. The customer has to return it to Loui&me within 14 days of delivery with no exceptions. Loui&me will compensate the cost of shipping.
At the event of products being sold due to incorrect pricing caused by technical problems and/or mistakes by personnel of Loui&me we reserve the right to cancel the order, refund the money and inform the customer of the situation.
7. CANCELLATION, EXCHANGE AND RIGHT OF RETURN
7.1 As a customer within EU you have the right to cancel your purchases without giving any reason within a period of 14 calendar days after the day of delivery of the goods. If you are not happy with the product (but it is in a perfect condition) or something has happened (which should not), all you need is to send us the product back together with the receipt and description of the problem. The goods have to be undamaged and unused, with any Loui&me’s labels or tags intact. Returns that are damaged or soiled, washed, altered or worn (other than to try the item on) may not be accepted and may be sent back to the customer and/or a refund refused. All items returned should include the completed returns note with an order reference number and your contact details. Unidentified returns may not be eligible for a refund
7.2 If you acknowledge a production error the goods can be returned against a valid receipt and/or order confirmation. For faulty items Loui&me will make a full refund to you, including for return shipping, as soon as possible. Goods are faulty if they are received damaged or where a manufacturing fault occurs within six months of purchase. Items that are damaged as a result of normal wear and tear are not considered to be faulty. Where possible, Loui&me will offer to repair faulty items. Shall the items cannot be repaired or the same product is not available for re-order, the customer is entitled to a full refund including cost of shipping and return.
7.3 Once the order has been placed and an order confirmation email has been sent, Loui&me will start to handle the order. At this point the customer cannot make any changes to the order. If there is any mistake made in registering customer contact or address details when placing the order, it is your responsibility to immediately contact Loui&me. Loui&me is not responsible for goods sent to a wrong and/or incorrect address submitted by customers.
7.4 If customers wish to exchange goods in an already delivered order, whereby for example the wrong size has been ordered, we ask customers to return the goods wished to be exchanged and place an new order with the correct item(s). In the event of questions or assistance please contact our customer service.
8. PERSONAL DATA
8.1. By registration at www.loui.me you agree for the processing of personal data related to the orders being placed at www.loui.me. Lack of your consent thereto will not allow for order processing. You are also responsible for providing correct and true personal data.
8.2. Personal data are protected as per the Act of August 29, 1997 on protection of personal data (Journal of Law of 2002, No. 101 item 926, with further amendments) to prevent access of third parties.
8.3. Pursuant to the a.m. Act, all customers of Loui&me are entitled to review their data, to have them updated or removed.
9. FORCE MAJEURE
In case of force majeure, all obligations contracted by loui.me are procrastinated. In this case the contract between you and Loui&me can be partially or fully terminated by the customer or by Loui&me. A force majeure shall be understood as the event(s) of natural disasters, war, strikes, revolution, riot, import/export lockout and/or blockage, transportation interference, failure of electricity, telephone or internet service and/or disease whether this strikes us as an organization or one of our suppliers direct or indirect.
